CookiesNerd respects the intellectual property rights of others and expects users of our website to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to claims of copyright infringement that are reported to us in the manner outlined below.

Filing a DMCA Notice of Copyright Infringement

If you are a copyright owner or an agent thereof and believe that any content hosted on CookiesNerd infringes your copyright, you may submit a DMCA Takedown Notice by providing the following information in writing to our Designated Copyright Agent:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit CookiesNerd to locate the material. Please include a direct URL to the allegedly infringing material to assist us in identifying the material.
  4. Contact information, including your name, address, telephone number, and email address, so that we may contact you if necessary.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

Counter-Notice to Restore Content

If you believe that the material you posted on CookiesNerd was removed or access to it was disabled by mistake or misidentification, you may submit a counter-notice. To file a counter-notice with us, you must provide the following information to our Designated Copyright Agent:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court in the judicial district where you reside (or in the United States District Court for the district in which CookiesNerd is located if you are outside of the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notice, we will forward it to the party who submitted the original DMCA notice. The original complainant will then have 10 business days to file a legal action against you in order to keep the content disabled. If no such action is filed, we will restore the material in question within a reasonable timeframe.

Repeat Infringer Policy

CookiesNerd takes copyright infringement seriously. We will terminate user accounts, when appropriate, for repeat infringers in accordance with the DMCA and applicable laws.
